By purchasing, operating, charging, riding, modifying, transporting, or using any electric bicycle, lithium-ion battery, charger, or related product sold by JDubs Racing LLC, you acknowledge and agree to the following terms:

1. Assumption of Risk

Electric bicycles, high-performance electronic vehicles, lithium-ion batteries, chargers, and related components involve inherent and unavoidable risks, including but not limited to:

• Loss of control
• Collision or crash
• Serious bodily injury
• Paralysis
• Death
• Fire or explosion
• Electrical malfunction
• Property damage
• Battery failure or thermal runaway
  

You understand that these risks may result from improper use, misuse, negligent operation, improper charging, improper storage, unauthorized modifications, poor maintenance, road conditions, rider inexperience, or failure to follow safety precautions.

By purchasing and using products from JDubs Racing LLC, you voluntarily assume all risks associated with ownership and use of these products.

2. Rider Responsibility & Safety Requirements

The customer and rider are solely responsible for the safe operation and handling of all products purchased from JDubs Racing LLC.

You agree to:

• Always wear a DOT-approved helmet and appropriate safety gear while riding.
• Inspect the bike, battery, brakes, tires, throttle, steering, and components before each use.
• Operate the product responsibly and within your skill level.
• Obey all local, state, and federal traffic laws and regulations.
• Ride only in safe and lawful areas.
• Avoid reckless riding, stunts, racing, jumping, or dangerous maneuvers.
  Keep both hands on the handlebars while operating the vehicle.
• Maintain awareness of pedestrians, vehicles, obstacles, and road hazards.
• Properly maintain and service the product as needed.
  

Failure to follow these safety precautions may result in serious injury or death.

3. Lithium-Ion Battery & Charging Warning

Lithium-ion batteries can be dangerous if improperly used, charged, modified, damaged, stored, or transported.

You acknowledge and agree that:

• Batteries must only be charged using approved chargers and according to manufacturer instructions.
• Batteries should never be left unattended while charging.
• Batteries must be stored in a dry, temperature-controlled environment away from flammable materials.
• Damaged batteries must not be used or charged.
• Improper charging, modification, misuse, water exposure, impact damage, overcharging, puncture, or neglect may result in fire, explosion, toxic fumes, severe injury, death, or property damage.
  

JDubs Racing LLC is not responsible for damages caused by improper battery handling, charging, storage, modification, misuse, or neglect.

4. Minor Riders

JDubs Racing LLC strongly recommends that riders under the age of 18 operate electric bicycles only under adult supervision.

Parents and guardians assume full responsibility for minors operating or using products purchased from JDubs Racing LLC, including ensuring that minors:

• Wear proper safety equipment
• Understand safe riding practices
• Follow all applicable laws
• Operate the product responsibly and within their abilities
  

5. Compliance With Local Laws

You are solely responsible for determining whether the operation of your electric bicycle or related products complies with all local, state, and federal laws in your area.

Laws regarding:

• Helmet requirements
• Age restrictions
• Sidewalk use
• Bike lane access
• Registration
• Licensing
• Speed limits
• Off-road usage (may vary by jurisdiction.)

JDubs Racing LLC makes no guarantees regarding the legality of product use in any specific location.

6. Release of Liability

To the fullest extent permitted by law, you agree to release, waive, discharge, and hold harmless JDubs Racing LLC, including its owners, employees, affiliates, contractors, manufacturers, distributors, and representatives, from any and all claims, liabilities, damages, losses, costs, or expenses arising from or related to:

• Product use or misuse
• Riding accidents or collisions
• Battery charging or storage
• Fire or property damage
• Mechanical or electrical failure
• Rider negligence
• Modifications or aftermarket alterations
• Failure to wear protective equipment
• Failure to follow safety instructions
  

This release includes claims for personal injury, wrongful death, property damage, economic loss, or any other damages arising from the use or ownership of products sold by JDubs Racing LLC.

7. Acknowledgment

By checking this box and completing your purchase, you acknowledge that:

• You have read and understood this Safety & Liability Acknowledgment.
• You understand the risks associated with electric bicycles and lithium-ion batteries.
• You voluntarily accept all risks associated with ownership and use.
• You agree that JDubs Racing LLC shall not be liable for injuries, damages, or losses arising from product use.
• You are at least 18 years old, or are purchasing under the supervision and consent of a parent or legal guardian.
